General Information In accordance with the Northern Territory (NT) Traffic Regulations Schedule 3 Australian Road Rules (see “ARR.doc” attachment on the Traffic Regulations webpage) the following Rules provide safety restraint requirements for drivers and passengers in motor vehicles: Rule 264 the driver of a motor vehicle that is moving, or is stationary but not parked, must wear a seatbelt Rule 265 a passenger over 16 years of age in motor vehicle that is moving, or is stationary but not parked, must wear a seatbelt Rule 266 (1) the driver of a motor vehicle that is moving, or is stationary but not parked, must ensure that each passenger under 16 years of age wear a seatbelt. This Rule further provides details on the type of safety restraint to be used based on the age of the child / person and includes: (2) Under six months a suitable and properly fastened and adjusted rearward facing approved child restraint (2A) Six months to under four years a suitable and properly fastened and adjusted: - rearward facing child restraint or - forward facing approved child restraint with an inbuilt harness (2B) Four years to under seven years - a suitable and properly fastened and adjusted forward facing approved child restraint with inbuilt harness' or - a properly positioned approved booster seat restrained by a seatbelt that is properly adjusted and fastened (3) Under four years must not be in the front row of a vehicle that has two or more rows of seats (3A) Four years to under seven years must not be in the front row of a motor vehicle that has two or more rows of seats unless all of the other seats in the row or other rows behind the front seat are occupied by children who are also under seven years of age (4) Over seven years - Adult seatbelt or - a properly positioned approved booster seat restrained by a seatbelt that is properly adjusted and fastened Note: ages specified are a guide. If a child is too small / large for the restraint specified for their age, a child safety restraint appropriate for their size should be used. A condition of the carriage of passengers within Remote Health Branch (RHB) vehicles is the use of appropriate safety restraints. The number of passengers within a vehicle should not exceed the number of safety restraints. It is important to note that under current legislation the driver of a vehicle is held responsible to ensure that passengers are appropriately restrained within the vehicle. NT Fleet policy states that employees are “responsible to maintain up-to-date knowledge of and obey the laws and associated regulations and by-laws of the Northern Territory as they relate to driving or being in charge of a motor vehicle.” The driver is therefore responsible to pay all fines incurred while the vehicle was in their use. This includes but is not limited to: Fine ($) Demerit Points Driver fails to wear seat belt 400 3 Driver fails to ensure a child under 16 years wears seat belt / restraint 480 (Plus $20 Victims of Crime) 3 Note: an adult passenger who fails to wear a seat belt is responsible for the payment of the fine of $400.
