    MND ASSOCIATION GIFTS, HOSPITALITY AND INDUCEMENT POLICY 1. Introduction The Association must be impartial and honest in the conduct of its business and staff, volunteers and trustees must remain above suspicion. Therefore staff, volunteers and trustees must: a. Ensure that the interests of people affected by MND remain paramount at all times; b. Be impartial and honest in the conduct of Association business and abide by the Association’s values. All staff, volunteers and trustees have a duty to ensure that all Association funds are spent for the purpose for which they were intended. They also have a duty to comply with statutory requirements and in particular the provisions of the Companies Acts, the Charities Act, together with all good business and corporate governance practices. The Association has deemed it appropriate to have in place an explicit procedure for staff, volunteers and trustees to declare any gifts, hospitality or inducements offered by third parties. In addition, the Association considers it good practice to declare any gifts, hospitality or inducements offered but declined. This policy is intended to provide clear guidance to staff, volunteers and trustees on the procedure to be followed in the event that any gifts, hospitality or inducements are offered and establishes an Association Gifts and Hospitality Register whereby such offers can be recorded. 2. Legal Framework & General Principles Trustees of the Association are prohibited under statute from receiving any benefit from the Association unless they have express legal authority to do so. The Associations Memorandum and Articles of Association provide express authority to the trustees to claim certain limited benefits however where the benefit offered is not covered in clause 5 of the Memorandum of Association consent to accept the gift or hospitality must be obtained from the Charity Commission or via a court order.
